What Is Visitation?

A child custody case in Texas typically involves designating one parent as the custodial “primary parent.” The child’s primary residence (typically used for determining school enrollment) is with the custodial parent. The other parent, the noncustodial parent, is ordered a possession schedule, or visitation schedule. The parent named primary will typically also be given the exclusive right to receive child support on behalf of the child, payable by the noncustodial parent. The primary parent does not necessarily get more time with the child. A parenting plan addressing child custody, possession and access will be established by the court, and will detail the visitation schedule granted to both parents. The needs and best interests of the child will be considered when determining this parenting plan.

Modifying Child Custody and Visitation

Over time, the lives of parents and children change. A child custody and visitation plan that once worked for the family may no longer do so. In these cases, it may be necessary to modify the child custody plan. However, in Texas, it must be shown that a significant change in circumstances has occurred, which warrants a modification. Again, the best interests of the child involved will be considered.
