What are my Rights as a Parent?

A child custody case in Texas typically involves designating one parent as the custodial/ “primary parent.” The child’s primary residence (typically used for determining school enrollment) is with the custodial parent. The other parent, the noncustodial parent, is ordered a possession schedule. The parent named primary will typically also be given the exclusive right to receive child support on behalf of the child, payable by the noncustodial parent. The primary parent does not necessarily get more time with the child. A parenting plan addressing child custody, possession and access will be established by the court, and will detail the visitation schedule granted to both parents. The needs and best interests of the child will be considered when determining this parenting plan.
